Chase Ends in Arrest, Drug Charges

A 45-year-old Morganton resident is in trouble with the law again after allegedly attempting to elude authorities in a vehicle chase.

Officers with the Burke County Narcotics Task Force received a tip that Elwood Avery of 102 Spainhour Street had drugs in his possession. The officers located Avery as he was leaving his residence in a minivan.

According to a BCNTF press release, the officers attempted to stop Avery for driving while his license was revoked, but Avery refused to pull over. Officers chased the vehicle through several Morganton city streets. While the vehicles were in transit, Avery allegedly threw what appeared to be crack cocaine out of the window.

The chase ended on North Terrace Street and Avery was taken into custody. Avery was searched and found in possession of marijuana and an undisclosed amount of money. A search of the minivan revealed more crack cocaine and drug paraphernalia. Officers later searched Avery's residence and located additional crack cocaine and marijuana. The drugs he allegedly threw from the vehicle during the chase were recovered, according to authorities.

Avery, who has a previous criminal record which includes armed robberies, was charged with possession with intent to sell and deliver cocaine, felony speeding to elude arrest, failure to stop for blue light and siren, driving while license revoked, and reckless driving. He was placed under a $25,000 secured bond and will make a first court appearance on January 10th.

Assisting in the arrest of Avery was the Morganton Department of Public Safety and their K-9 dog, Rocko.
