Man Charged with Common Law Robbery |

An 85-year-old Morganton man
reported to authorities on January 16th that he had been forced to give a
Denver, N.C. man a check for $100. The Denver man now faces charges of common
law robbery.
According to Detective Aaron Carver, James Ray Gillian
(left), 46, of 6397 Winchester Road, Denver intimidated Jacob James Fox with
his demanding demeanor and forced Fox to write the check. |

| Fox, who lives at 1231 Tom Fox Street in
Morganton, told Carver that Gillian came to his residence around 8:30 a.m. and
told him (Fox) his name was Bob Brown, who had hunted with him in the past. Fox
later told Carver he had never seen Gillian before. |

| Gillian allegedly asked Fox to give him $150
cash, but Fox told him he didn't have any money. Gillian reportedly became
demanding, and Fox wrote him the $100 check. Gillian left the residence after
receiving the check. |

| Fox was not injured, Carver said. |
| |
| After further investigation, Carver charged and
arrested Gillian, who was placed in the Burke Catawba District Confinement
Facility under a $10,000 bond. His first court appearance was January
25th. |
