Burke Records First Murder of 2005
 
 A Burke County man is in jail and charged with murder after an early morning altercation in the Rutherford College area.

Detectives say that Danny Boyd Gardner (left), 47, of 141 Estes Drive, Connelly Springs, shot Kevin Lynn Poarch to death early Saturday morning after Poarch became involved in an altercation with his son, Matthew Poarch. The altercation reportedly occurred at Gardner's residence.
 
Deputies responded to Gardner's residence on Friday after a caller stated that Kevin and Matthew Poarch were involved in an altercation. When deputies arrived, the matter had been resolved and no law enforcement was needed, according to detectives. 
 
Shortly after deputies left Gardner's home, they were called back to the residence after the Sheriff's Office received a call that someone had been shot. 
 
Upon arrival, deputies learned that Matthew Poarch had taken his father to Valdese Hospital to be treated for a gunshot wound. Deputies took Gardner into custody after learning that he was Poarch's suspected assailant.
 
Kevin Poarch was pronounced dead shortly upon arrival at Valdese Hospital. 
 
Detectives said Kevin Poarch and Matthew Poarch were apparently involved in some type of altercation outside of Gardner's residence, and Gardner attempted to break up the fight. His efforts escalated into an altercation with both Kevin and Matthew, and Gardner reportedly fired the fatal shot that killed Kevin Poarch.
 
Danny Gardner was jailed under no bond awaiting a first court appearance on Monday, April 11th.
