Sheriff's Office Investigating Death
 
On October 27, 2007, at approximately 11:53 pm, the Burke County Sheriff's Office received a call from Burke County Emergency Services, in reference to a 911 call, where an alleged assault had occurred at 1460 Avery Road in Morganton.
 
The Sheriff's Office was advised the victim was a male subject that was unconscious, but he was breathing.
 
Burke County deputies responded to the scene and later learned that the victim was deceased. The Criminal Investigations Division responded and conducted an investigation.
 
Investigators interviewed numerous witnesses who stated that the victim, Cedric Labarryan Emmons, and the suspect Neal Randolph Avery, had been playing cards and drinking at Emmons' residence. A short time later Emmons and Avery began picking around with each other and then started wrestling.
 
Witnesses stated Avery was able to get Emmons in a headlock and held him face down, not allowing Emmons to get up. After a while, one of the witnesses called 911 because Emmons was breathing, but unconscious. Witnesses said they attempted CPR on Emmons, but were unsuccessful.
 
Investigators conferred with the District Attorney's Office in reference to the findings of the investigation up to this point. The case is still under investigation at this time.
