Judge Passes Away |

| On July 19,
2009, at approximately 8:08 pm, the Burke County Sheriff's Office was notified
of a medical emergency located at the end of Jamison Drive off of Lail Road in
the Glen Alpine community. The incident was reported to have been located in
the Catawba River. |

| Upon the
arrival of first responders, the Glen Alpine Police Chief, and Burke County
deputies, it was learned that the person in medical crisis was 25th District
Court Judge, John Mull. |
| |
| First
responders and family members were engaged in CPR when Emergency Services
arrived. EMS then transported Mr. Mull to Grace Hospital where he was
pronounced dead on arrival. |

| At
approximately 8:30 pm, Burke County detectives were called to provide a
preliminary investigation into the crisis. |
| |
| Early
information provided to investigators suggested that Mr. John Mull may have
been assisting another family member, who was having difficulty swimming in the
Catawba River, just feet from the banks of the Mull property. |

| Once that
family member (a juvenile) was safely to shore, it was noticed by other family
members and friends that John Mull was missing. Within approximately two
minutes, Mr. Mull was located under water and was unresponsive. Mr. Mull was
brought to shore and CPR was initiated by friends and family. |

| It is unclear
at this time in the investigation if this is a drowning case or a medical
emergency case, such as cardiac arrest. Currently investigators are treating
the case as a medical crisis case with no suspicious circumstances. |
